RV Park Apps End User License Agreement

Website: RVParkApps.com Effective date: October 1, 2026 LEGAL REVIEW DRAFT — underlined text marks revisions and recommended MVP practices. Italic annotations identify legal and implementation checks. Confirm actual practices before publication.

This End User License Agreement (Agreement) is between you (you or End User) and RV Park Apps, LLC, doing business as RV Park Apps (Company, we, us, or our). It governs your use of RV Park Apps mobile applications, web applications, progressive web applications, administrative interfaces, related documentation, and updates (collectively, the Application). The Application is licensed, not sold.

The Application helps RV parks, campgrounds, and related properties (Parks) share information and manage their communities. You may use it as a visitor, resident, guest, employee, manager, or Park owner. A Park is a separate business from Company unless expressly stated otherwise.

BY SELECTING AN ACCEPTANCE BUTTON OR CHECKBOX PRESENTED WITH THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND IT AND AGREE TO BE BOUND BY IT. IF YOU DO NOT AGREE, DO NOT ACCEPT, INSTALL, OR USE THE APPLICATION. A PERSON ACCEPTING ON BEHALF OF A BUSINESS REPRESENTS THAT THEY HAVE AUTHORITY TO BIND THAT BUSINESS.

1 License grant and authorized access

Subject to this Agreement and any applicable subscription entitlements, we grant you a limited, nonexclusive, nontransferable license to install and use the Application on devices you own or control and access its hosted features for your personal use or your authorized Park operations. You may view, download, and share content only as permitted by its owner and the access controls provided in the Application.

Access to a Park account, administrative features, resident information, or restricted documents requires authorization. A public Park page does not authorize access to private content. Permissions may differ by Park, role, subscription, and enabled module. You do not receive a license to resell our platform or offer unrelated services using it.

2 Accounts and eligibility

You must be legally capable of accepting this Agreement. If you are not, a parent or legal guardian must authorize and supervise your use where legally permitted. Park owners, managers, and other persons entering subscription contracts must be at least 18 years old and authorized to act for the Park.

Provide accurate account information, protect your credentials and sign-in links, and promptly notify us of suspected unauthorized access. Do not share administrative credentials, impersonate another user, or use a role that has not been assigned to you. You are responsible for activity you authorize and for your own failure to protect account access; this does not excuse our obligations under applicable law.

Parks control their memberships and staff permissions. We may verify authority or resolve account ownership disputes before transferring administrative access.

3 Restrictions and acceptable use

Except where applicable law permits otherwise, you may not copy or distribute the Application beyond the license granted; modify or create derivative software from it; reverse engineer, decompile, or attempt to obtain its source code; remove proprietary notices; sublicense or resell it; bypass billing, security, access controls, or usage limits; or access another Park’s data without authorization.

You may not upload malware, disrupt service, harvest private information, send unlawful or unsolicited messages, infringe intellectual property or privacy rights, publish unlawful or abusive content, or use automated access that harms the service. Security testing requires our prior written authorization. These restrictions do not prohibit lawful downloading or sharing of Park content expressly made available for that purpose.

The Application is not designed for safety-critical operations, emergency dispatch, life-support systems, or other uses where failure could cause death or serious injury.

4 Ownership and your content

Company and its licensors retain ownership of the Application, platform software, design, documentation, trademarks, and related intellectual property. No ownership is transferred by this Agreement.

You or the applicable rights holder retain ownership of documents, images, text, events, messages, branding, recordings, and other material you submit (User Content). You grant us a nonexclusive, worldwide license to host, store, reproduce, format, transmit, and display User Content only as reasonably necessary to operate, secure, support, and improve the service for you, carry out your instructions, and meet legal obligations. This includes processing content with service providers used to deliver enabled features.

This license ends when the relevant content is deleted from our systems, except for permitted backups, legally required retention, and copies already delivered to authorized recipients. It does not grant us ownership of your content or unrestricted rights to commercialize private information.

You represent that you have the rights and permissions needed to submit content and make it available to its selected audience. You are responsible for choosing its visibility and obtaining required permissions from people whose information you upload. We remove GPS and unnecessary EXIF metadata from images made accessible through the Application. Uploading content does not authorize external promotional use of your images or private information without appropriate separate permission. Legal and implementation review: Confirm metadata removal for accessible originals and derivatives, and obtain appropriate promotional permissions.

5 Park information and responsibilities

Parks are responsible for their rules, operating hours, maps, directions, listings, emergency contacts, notices, events, documents, amenities, and other Park-provided information. Managers must review content for accuracy, maintain it, and identify information that should be restricted to authorized users.

Company provides the software and does not operate the Park, provide campsites or accommodations, guarantee amenities, or enforce Park rules. Reservations, leases, purchases, refunds, employment applications, and services offered by a Park or its partners are subject to that provider’s terms. A reservation or booking is not confirmed merely because it appears in an assistant response or an unconfirmed request.

When information is unclear or inconsistent, contact the Park directly. The Application does not replace your lease, reservation agreement, posted safety instructions, or applicable law.

6 Parkie and speech features

Parkie is an optional AI assistant that may help search authorized Park information, answer questions, transcribe speech, and draft content. Available features depend on your role and enabled modules. AI responses and transcriptions can be inaccurate, incomplete, or outdated and may misunderstand names, dates, times, rules, or spoken instructions.

Confirm important details against the original source or with the Park. Managers remain responsible for reviewing and approving generated content before publication or distribution. Do not rely on Parkie for emergency, medical, legal, or other professional advice. Parkie does not have authority to make binding commitments or change your reservation, account, or Park rules unless an expressly supported action is separately confirmed.

Microphone and other device permissions are requested when needed. Typed input remains available instead of speech. Only the audio, request text, relevant context, and authorized content necessary for your request are sent to AI or speech providers. We do not retain voice recordings in our own storage after transcription or use private User Content to train general-purpose AI models. Provider processing and retention may differ from our own and are described in the Privacy Policy. Speech transcription does not create voiceprints or identify users through biometric characteristics. Avoid submitting unnecessary sensitive information. Legal and implementation review: Confirm AI and speech providers, processing countries, retention, no-training arrangements, audio handling, and absence of biometric identification before publication.

7 Privacy and operational access

Our collection, use, retention, and disclosure of personal information are explained in the Privacy Policy presented with the Application at https://rvparkapps.com/privacy/. Acknowledging this Agreement does not replace any separate consent required by law for cookies, marketing, recordings, or other processing.

The service may process account details, Park memberships, documents, messages, engagement activity, device information, and speech inputs as described in the Privacy Policy. Park managers receive aggregated engagement reports rather than individual browsing histories; individual RSVPs, requests, bookings, and delivery records may be available to authorized staff for operational purposes. Raw Parkie questions and answers are excluded from engagement analytics. The MVP does not collect precise GPS, background location, geofencing data, or device location history. It does not sell personal information, share it for cross-context behavioral advertising, or use it for targeted advertising. Static sponsored listings may be displayed without cross-site tracking. The MVP does not use advertising pixels, retargeting, or session-replay tools. Legal and implementation review: Verify analytics, small-group aggregation, SDKs, map/weather services, marketing website tracking, and provider contracts. General IP-derived location and essential session technologies remain described in the Privacy Policy.

Authorized Company personnel may access accounts or use controlled impersonation only for legitimate support, security, troubleshooting, or administration. Superuser access requires multifactor authentication. Impersonation requires a recorded reason, a banner visible to the acting staff member, and audit logs identifying the staff member, target account, and relevant activity. Access is restricted by Park and assigned role. This does not authorize unrestricted browsing of private information. Legal and implementation review: Verify tenant isolation, MFA, audit coverage, session limits, and sensitive-action restrictions. These are proposed implementation commitments, not verified production controls.

8 Notifications and SMS

You may receive in-app notices, push notifications, email, or SMS according to enabled features, your preferences, and applicable consent requirements. Message delivery and timing depend on device settings, connectivity, carriers, and third-party services and are not guaranteed. The Application is not a reliable emergency alert system; contact local emergency services directly in an emergency.

Where SMS is offered, message frequency varies and carrier message and data rates may apply. Follow the opt-out and help instructions included in messages, including STOP or HELP where supported. Consent to marketing messages must be obtained separately where required and is not a condition of purchasing a subscription.

Parks sending messages are responsible for appropriate consent, lawful audience selection, opt-outs, and message content. Company may restrict messaging that violates law, provider rules, or this Agreement. Mobile numbers, SMS opt-in records, and consent are not sold or shared for third parties’ or affiliates’ own marketing. Providers may process them to deliver and support messaging, or disclosures may occur as required by law. Legal and implementation review: Confirm consent records, opt-out enforcement, provider restrictions, and messaging evidence retention.

9 Subscriptions publication and saved drafts

A Park may create an account and save setup information and drafts without purchasing a subscription. A paid subscription is required to publish a guest portal and use paid features unless we expressly grant an exception. Completing setup does not itself authorize a charge or publish the Park.

The plan, price, billing interval, recurring-charge terms, taxes, cancellation method, and applicable refund terms must be disclosed before purchase. Recurring billing begins only after the authorized purchaser affirmatively agrees. Guests are not responsible for the Park’s subscription merely because they use its app. Any guest purchase requires a separate transaction. Company subscription payments use a processor’s hosted payment interface. Company systems do not receive or store full card numbers or card security codes. Legal and implementation review: Identify the payment processor and verify checkout, webhooks, logs, and support tools.

The applicable subscription agreement, order form, or SaaS Terms of Service controls business pricing, renewal, cancellation, usage limits, and service commitments. Deleting a mobile app does not cancel a paid subscription; use the disclosed account or store cancellation process.

We do not delete saved Park data solely because setup was abandoned, payment was not completed, or a subscription lapsed. Public access and paid functions may be restricted while authorized management access remains available for recovery, subject to security restrictions. Retention and deletion follow the Privacy Policy and applicable law; storage limits may restrict new uploads but do not alone authorize deleting existing content. Proposed defaults are 30 days for Parkie conversation history, 90 days for raw engagement events, 12 months for security and impersonation logs, and a rolling 30-day backup window. Content deliberately saved into the CMS follows the Park-content retention rules. These practices do not override valid individual deletion requests or justify indefinite retention of unnecessary personal information. Legal and implementation review: Approve retention periods with counsel and implement them across databases, storage, providers, and backups. Set personal operational-record, billing-record, and SMS evidence schedules; confirm deletion propagation and backup restoration controls. Preserve data through unpaid states as required by the product.

10 Mobile distribution and external services

A dedicated mobile app build or store submission requires a separate manual request and any applicable service agreement. Payment or web publication does not automatically initiate submission. Store approval, review timing, continued listing, and availability are controlled by the relevant app store and are not guaranteed.

The Application may link to booking engines, payment processors, maps, weather services, social networks, local businesses, and other third-party services. Their terms and privacy practices govern your interactions with them. We do not control their content or guarantee their performance. You must comply with applicable third-party agreements, including your device and carrier service terms.

11 Updates and service changes

We may release updates to improve security, compatibility, usability, and functionality. Install required updates to continue using supported features. Hosted features may change without reinstalling the Application. We will provide notices and remedies required by applicable law or your subscription agreement for material changes to paid services.

Availability may be affected by maintenance, connectivity, security incidents, or third-party outages. No service-level commitment applies unless expressly stated in your subscription agreement.

12 Suspension and termination

This Agreement begins when you accept it and continues until terminated. You may stop using the Application and request account closure through the published support process. Uninstalling the Application does not itself delete your hosted information or terminate a Park’s subscription.

We may suspend or terminate access for a material breach, unauthorized access, security threats, unlawful use, or service discontinuation. Where practical, we will provide notice and a reasonable opportunity to resolve the issue; immediate action may be necessary for security, legal compliance, or serious harm. Subscription-related restrictions and cancellation are also subject to the applicable subscription agreement.

After termination, cease using the licensed software and remove installed copies. Hosted data is handled under the applicable retention, deletion, and export policies. Content ownership, accrued payment obligations, confidentiality and privacy obligations, liability provisions, and terms intended to survive remain effective.

13 Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPLICATION AND RELATED CONTENT ARE PROVIDED AS IS AND AS AVAILABLE. EXCEPT FOR EXPRESS COMMITMENTS IN AN APPLICABLE WRITTEN AGREEMENT, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OPERATION, ERROR-FREE OUTPUT, MESSAGE DELIVERY, OR THE ACCURACY OF PARK OR AI-GENERATED CONTENT.

Nothing in this Agreement excludes a warranty, consumer guarantee, or statutory remedy that cannot lawfully be excluded.

14 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM THE APPLICATION, WHETHER BASED ON CONTRACT, TORT, OR ANOTHER LEGAL THEORY.

SUBJECT TO THE EXCEPTIONS BELOW, COMPANY’S TOTAL LIABILITY FOR CLAIMS ARISING FROM THIS AGREEMENT WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNTS YOU PAID COMPANY FOR THE AFFECTED SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. A SEPARATE SIGNED CUSTOMER AGREEMENT MAY PROVIDE A DIFFERENT LIMIT FOR A PARK.

These limitations do not exclude liability for fraud, willful misconduct, or any other liability that applicable law prohibits limiting, including applicable rights relating to death or personal injury. Mandatory consumer rights remain unaffected.

15 Claims arising from your conduct

To the extent permitted by law, a Park or other business user agrees to defend and indemnify Company and its personnel against third-party claims arising from that business user’s unlawful content, infringement of third-party rights, or material violation of this Agreement. This obligation does not cover claims caused by Company’s own breach, negligence, or misconduct.

We will promptly notify the business user of the claim, provide reasonable cooperation, and allow that user to control the defense with qualified counsel. No settlement may impose obligations on Company or admit fault on its behalf without its written consent. This business indemnity does not impose a general indemnification obligation on individual consumers.

16 Apple application terms

For Apple downloads, this Agreement is with Company, not Apple. Company handles support, undisclaimed warranties, application-related claims, and investigation, defense, settlement, and discharge of intellectual property claims. Apple owes no support. For a warranty failure, notify Apple for a purchase-price refund; Apple has no other warranty obligation to the extent legally permitted, and Company handles remaining warranty claims.

Use is licensed on Apple products you own or control under Apple Media Services usage rules, including permitted Family Sharing or volume-purchase access. Apple and its subsidiaries are beneficiaries entitled to enforce this Agreement. You confirm you are not in a US-embargoed or US-designated terrorist-supporting country or on a US prohibited-party list. Company contact details appear below.

17 Legal compliance and location

You must comply with applicable laws, including relevant export controls and sanctions. Features may not be offered in every jurisdiction. Access outside supported markets is subject to local law. Nothing in this Agreement requires conduct prohibited by applicable law.

18 Governing law and dispute resolution

This Agreement is governed by the laws of Texas, United States, excluding conflict-of-law rules, except where mandatory law provides otherwise. Subject to mandatory consumer rights, disputes will be brought in the competent courts located in Travis County, Texas, United States.

This clause does not deprive consumers of nonwaivable protections or rights to bring claims in courts available under applicable law. This Agreement does not impose mandatory arbitration, a class-action waiver, or a shortened statutory claim period. Legal and implementation review: Counsel should confirm the Texas and Travis County provisions and mandatory consumer-law exceptions for supported markets.

19 Changes and other agreements

We may revise this Agreement and will identify its effective date. Material changes will be communicated through an appropriate notice, and renewed acceptance will be requested where required. Changes do not retroactively remove accrued rights.

This Agreement governs the Application license. A signed customer agreement or subscription terms specifically agreed by a Park govern that Park’s commercial service relationship and control an express conflict on those subjects. The Privacy Policy explains data processing and does not waive privacy rights. Park policies govern the Park’s operations and do not change this license.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision is not a waiver. This Agreement and applicable expressly accepted agreements constitute the agreement concerning their respective subject matter.
